The Best Rewards Program Ever™

ELIGIBILITY

Membership in the Rugged Wearhouse® Best Rewards Program Ever™ (or "Program") is open to individual U.S. residents of the 50 States, who are at least 16 years of age, who provide and maintain a valid e-mail address.  By joining the program, you represent that you are at least 16 years of age or older.  If you are between 16 and the age of majority (as determined by your state law), you agree that you have obtained permission from your parent or legal guardian to be a member of the program.  Members acknowledge that from time to time, they may be required to provide proof of eligibility in the Rugged Wearhouse® Best Rewards Program Ever™ by photo id, or similar.  Resellers are not eligible to participate in the Rugged Wearhouse® Best Rewards Program Ever.  Associates are not eligible to participate in the Rugged Wearhouse® Best Rewards Program Ever™.

Rugged Wearhouse® in its sole discretion reserves the right to confirm eligibility.  Registrations determined to be incomplete, reproduced, falsified, altered, or tampered with in any way will be terminated.  Participation in the Program constitutes a member's full and unconditional agreement with these Rules, which are final and binding in all matters related to the Program.  Any registration submitted with an invalid mail or email address will be terminated.  Each member must register on his/her own behalf.  Any registration submitted on behalf of another individual or using another person's telephone number or email address will be terminated.  No mechanically reproduced or automated entries permitted.

 

GETTING STARTED

There are 2 ways to enroll in the Rugged Wearhouse® Best Rewards Program Ever™, and best of all, Membership is free!

The First Way to Enroll is to Visit a Rugged Wearhouse® Store:

1.      Tell your cashier at checkout that you would like to enroll in the Rugged Wearhouse® Best Rewards Program Ever™, give them your email address, and the cashier will provide you with your membership card.

2.      You must then activate your membership online at www.ruggedwearhouse.com to start receiving points for your purchases.  You will need to provide your: name, age, physical address, email address and telephone number, and other demographic information.

The Second Way to Enroll is to Visit us Online:

1.      Go to www.ruggedwearhouse.com.

2.      Select register without card.  You will need to provide your: name, age, physical address, email address, telephone number, and other demographic information.

3.       Your membership card will be mailed to you within 7-10 business days, and you will start receiving points for your purchases.

EARNING REWARDS

Once you have activated your account, you can start earning points whenever you present your Rugged Wearhouse® Best Rewards Program Ever™ membership card for eligible purchases at Rugged Wearhouse® stores.  As a member of the Rugged Wearhouse® Best Rewards Program Ever™, there are 2 ways in which you can earn rewards: Monthly Rewards and Annual Rewards.

1)      Monthly Rewards.  This reward is based on how much you spend in a Rugged Wearhouse® store within a calendar month. 

 

a)      For each dollar you spend, you will earn 1 reward point.  

 

b)      For every 50 reward points you accumulate in a month, you will earn a $5.00 off reward coupon that can be applied towards a future purchase, provided it meets the minimum purchase requirement stated on the reward coupon. 

 

c)      In addition, if you are not eligible for a reward based on your total monthly spending, you can achieve a reward based upon the number of transactions you have in a given calendar month, as follows:

 

-For every 5 transactions where you spend at least $8 on each transaction, you will receive a $5.00 off reward coupon that can be applied toward a future purchase, provided it meets the minimum purchase requirement stated on the reward coupon.  You can only earn one of these reward coupons per month.

In all cases:

-An individual purchase can only be applied once toward a reward.

-A maximum of 3 reward coupons based on monthly spending can be earned per month.

-You may only redeem 1 Reward coupon per transaction, but remember that there is a minimum purchase requirement stated on the reward coupon that must be met.

-Although there is no limit to the number of points you can earn per day, only 1 transaction per day will apply toward a reward based on number of transactions (Section c above). 

-Reward coupons must be used within 2 weeks of their issue date or they will expire and no longer be valid. 

2) Annual Rewards.  Based on the cumulative amount of monthly points you earn within a calendar year, you can earn annual rewards.  Those that earn higher points will become members of “The RW Club”. The membership levels of The RW Club are Red, White and Blue. For example, if by June 1, 2013 you have earned 1,005 combined monthly reward points in 2013, you would receive Red status level benefits from July 1, 2013 (benefits begin 30 days after qualifying event) through December 31, 2013.

If for the previous calendar year, your combined monthly reward points equal at least 1,000 but less than 1,999, you will qualify for the Red status level.     

If for the previous calendar year, your combined monthly reward points equal at least 2,000 but less than 2,999, you will qualify for the White status level.     

If for the previous calendar year your combined monthly reward points equal at least 3,000, you will qualify for the Blue status level.

*Please note that monthly reward points earned in 2012 and 2013 will collectively be applied towards determination of 2013 annual reward status levels.   

ABOUT POINTS

You must identify yourself as a member of the Rugged Wearhouse® Best Reward Program Ever™ at the point of sale for you to receive reward points for your purchase. 

Points are based on dollars spent on qualifying purchases.  All merchandise purchases qualify under the program.  Sales tax and Gift Card sales do not qualify for points under the Rugged Wearhouse® Best Reward Program Ever™. 

Points will post to your Rugged Wearhouse® Best Rewards Program Ever account instantly, but no later than within 24 hours of your purchase date.

If an item is returned, points will be deducted from your Rugged Wearhouse® Best Rewards Program Ever™ membership equal to the amount of points earned for the applicable amount of that purchase.  

Points will be earned by only one Rugged Wearhouse® Best Rewards Program Ever™ membership per transaction.  

Membership cards, points, and reward coupons have no cash value. 

You cannot give or transfer your membership, membership card, points or reward coupons to anyone else.

Other restrictions or exclusions may apply. 

Points earned for the current purchase and for all points accumulated for the month and year are printed at the bottom of your transaction receipt.

On the first day of every month, your point total will start at zero.  On the first of every calendar year, your accumulated monthly totals will also be zero.  You begin earning points for a new calendar year on January 1.  The exception being monthly points earned in 2012, which will carry over into 2013. 

Reward points are valid only for the year in which they are earned, and will expire on December 31 of that year, with the exception of points earned in 2012, which will not expire until December 31, 2013.

REWARD COUPONS

Every point earned in the Rugged Wearhouse® Best Rewards Program Ever™, is applicable towards a reward coupon. Reward coupons are coupons for discounts off future purchases at Rugged Wearhouse® retail store locations, and may only be redeemed for a discount off minimum purchase amounts stated on the reward coupon.

Reward coupons will print out on the register receipt for the transaction in which you earn the reward.  To redeem your reward coupon, on a future purchase you will present the reward coupon to the cashier, who will then have you verify your membership, in ways such as presenting the membership card itself, presentation of valid identification, telephone number or e-mail verification to name a few means. 

Reward coupons are not transferable and may only be used by the member to whom issued.  Reward coupons may be used in conjunction with most other discounts or offers toward the purchase of products, pursuant to the minimum purchase amount stated on the reward coupon.  Unless noted otherwise on the reward coupon, each reward coupon will expire 14 days from the issuance date.  Reward coupons have no cash value.   Reward coupons may be used only once. Reward coupons expire at 11:59 pm Eastern Time on the expiration date shown on the Reward coupon. 

RECOVERY OF POINTS

If at the time of purchase, you do not have your membership card, you will need to provide your phone number or email address to the cashier to receive credit for your purchase.  If you make a purchase and did not provide your Rugged Wearhouse® Best Rewards Program Ever™ membership card at the time of purchase, you may request a recovery of points within 30 days of the purchase by calling customer service (800) 458-6546 extension 213.  You must have your receipt, or no points will be recovered.

ELIGIBLE PURCHASES

Rugged Wearhouse® Best Rewards Program Ever™ points will be earned on all goods purchased at Rugged Wearhouse®.  Points will NOT be earned on Rugged Wearhouse® Gift Card purchases but purchases made with Rugged Wearhouse® Gift Cards are eligible under the Rugged Wearhouse® Best Rewards Program Ever™.  Reward coupons and other discounts issued through this program may not be applied toward: i) the purchase of Rugged Wearhouse® Gift cards, ii) prior purchases, iii) purchases made for resale, and iv) sales tax.  Other exclusions may apply.

MEMBERSHIP STATUS

Members who have no qualifying point activity during any continuous 12-month period, will automatically have their membership expire on the last day of the 12th month of membership inactivity.  Memberships may be canceled at any time by notifying customer service by e-mail customerservice@gabes.net or phone (800) 458-6546 extension 213.  If your membership expires, is canceled or otherwise terminated for reasons other than a member's misconduct or malfeasance, they will receive any reward coupons they may be eligible for, with any remaining points forfeited.  

In situations involving misuse of the program, we specifically reserve the right to freeze or terminate any memberships or related memberships and stop future redemption of reward coupons issued from those accounts.  Rugged Wearhouse® reserves the right to terminate your membership for any reason or no reason and at its sole discretion.  If at any time your point balance becomes negative, we may immediately cancel or reverse any or all outstanding points and reward coupons issued from your account.

INELIGIBLE PARTICIPANTS

Resellers are specifically excluded from the program.  If in the sole discretion of Rugged Wearhouse®, it is determined that you purchase items for resale, we reserve the right to: i) not award points, ii) deduct improperly awarded Points, iii) invalidate any improperly issued reward coupons, iv) terminate a membership, and v) decline to open any future Best Rewards Program Ever™ memberships for people associated with such activity.

 

Employees, officers, and directors of Rugged Wearhouse, Inc., and any of their respective affiliated companies, parents, subsidiaries, distributors, advertising and promotional agencies, any and all other entities directly associated with the Program, as well as the immediate family members and members of the same household of any of the above are NOT eligible to participate in the Best Rewards Program Ever™.

COMMUNICATION

Communications about the program, including any changes, will be communicated by e-mail or on www.ruggedwearhouse.com. You specifically agree to provide and maintain a valid e-mail address and to keep Rugged Wearhouse® informed of any changes to your e-mail address.   Your membership is valid for use only at Rugged Wearhouse® retail store locations.  You begin to earn Points when you activate your account at www.ruggedwearhouse.com.  You agree to receive communications about the program, as well as advertising and marketing material from Rugged Wearhouse®.  All Information submitted becomes the property of Rugged Wearhouse®, and will not be returned and may be used for marketing and other promotional purposes.  If you do not want your information used for marketing and other promotional purposes, you must designate that at the time of registration.  Collection and use of information collected in the Program will be in accordance with Rugged Wearhouse® privacy policy as posted on www.ruggedwearhouse.com.

Rugged Wearhouse® may, at any time, modify the Best Rewards Program Ever™ rules by posting the modified rules at Rugged Wearhouse® www.ruggedwearhouse.com.  The current set of posted rules shall apply retroactively to all participants in the Program, regardless of when they sign up or began participating in the program.

GENERAL INFORMATION

Rugged Wearhouse® is not responsible for errors in the Program. By participating in the Program, members agree to release and hold harmless Rugged Wearhouse® and its parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability for loss, harm, or damage which may occur in connection with preparation for, or participation in, the Program, and for any claims or causes of action based on publicity rights, defamation, or invasion of privacy. Members acknowledge that Rugged Wearhouse® has made no warranties, representations or guarantees, express or implied, in fact or in law in relation to this Program.

 

All issues or questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of members or Rugged Wearhouse® in connection with the Program, are governed by the laws and regulations of the State of West Virginia, without giving effect to any West Virginia choice of law or conflicts of law rules. You agree that if you have a dispute with Rugged Wearhouse®  about the Program, you will try to resolve the dispute through negotiation with Rugged Wearhouse®. If agreement cannot be reached after negotiation, you agree to seek resolution through binding arbitration in the State of West Virginia.  By entering the Program, all participants consent to the jurisdiction of the State of West Virginia. The Program is subject to all applicable federal, state and local laws and regulations.

 

If for any reason, the Program is not capable of running as planned, due to infection by computer virus, malware, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Rugged Wearhouse®, which corrupts or affects the administration, security, integrity or proper conduct of the Program, Rugged Wearhouse® reserves the right, at its sole discretion, to disqualify any individual who tampers with the registration or point accumulation process (as applicable), and/or to cancel, terminate, modify or suspend the Program in whole or in part, at any time, without notice and to void all points and reward coupons.   Rugged Wearhouse®  assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, registrations.  Rugged Wearhouse® is not responsible for any problems with or technical malfunction of any telephone network or telephone lines, on-line systems, servers, or providers.  Sponsor disclaims all liability for the inability of an individual to complete or continue a registration due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond Rugged Wearhouse® control, or otherwise.  CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, RUGGED WEARHOUSE® RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE EXTENT PERMITTED BY LAW.
